The Connecticut FMLA was recently amended to enhance the rights of employees. The key amendments include the following. One, the CT-FMLA applies to employers with one (1) or more employees. Two, employee eligibility for leave kicks in after three (3) months of employment. Three, an employee whose CT-FMLA rights have been violated can sue directly in Court. There is a 180 day deadline from the date of the FMLA violation in which to file the lawsuit. FMLA violations include denial of leave, termination for requesting or taking leave, and failure to restore the person to her job upon return from leave.
