Connecticut law imposes double damages on employers who do not pay their workers' overtime pay. If an employee is not paid overtime wages, the employee has the legal right to bring a civil lawsuit. If the employee prevails in the lawsuit, the employee will recover double the full amount of the overtime pay owed, plus court costs and attorneys' fees. The only way an employer can avoid the douible damages is if the employer can prove that its decision to not pay the overtime was made in the good faith belief that the decision was in compliance with the law. Ignorance of the law or uncertainity of the current state of the law will not suffice to prove good faith.
