Connecticut employees have certain legal rights regarding their personnel files. The Connecticut Personnel Files Act, Conn. Gen. Stat. Sec. 31-128a et seq., establishes those rights. Of particular significance is the employee's right to submit a written statement rebutting information contained in an employer's disciplinary action, performance evaluation, or termination document. When an employer gives an employee a written disciplinary document, performance evaluation document or a termination document, the employer is required to notify the employee, in writing, that should the employee disagree with any information contained in the document, the employee can submit a written statement to the employer explaining the employee's position. Should the employee exercise such right, the employer must place the written statement in the employee's personnel file.
