Attorney James Sabatini obtained a settlement for his client in a disability and FMLA retaliation case. The settlement included job reinstatement and $235,000. The job reinstatement also brought the client up to date on his salary and all fringe benefits including retirement. The client was working for his employer when he needed to take a medical leave of absence to undergo surgery. He underwent the surgery and returned to work on a light duty basis. While working light duty, the employer was critical of our client's absences from work including the absences relating to his surgery. The employer then cited the absences as one of the reasons for terminating his employment. Using the medically-related absences as a basis to terminate our client's employment was illegal. Attorney James Sabatini brought suit against the employer in Connecticut federal court alleging retaliation in violation of the ADA, the FMLA and the Connecticut Fair Employment Practices Act. The case settled shortly before trial.
