Family and medical leave lawsuits are on the rise. According to the Administrative Office of the U.S. Courts, lawsuits filed under the FMLA jumped to 877 in 2013 from 291 in 2012. The Family and Medical Leave Act guarantees employees up to 12 weeks of unpaid leave a year for medical and family reasons. Employers are prohibited from interfering with an employee's FMLA rights. Employers are prohibited from retaliating against an employee for opposing FMLA violations.
