A $700,000.00 prejudgment remedy has been secured by Attorney Vincent Sabatini in a breach of contract case. The case involves of a contract involving rental retail space in Connecticut. In certain cases, there exists a real concern that a defendant's assets will be unavailable or insufficient at the time of a final judgment. To address this concern, a prejudgment remedy is sought which allows for the attachment of property/assets during the pendency of the litigation so that those assets can be used to satisfy a final judgment. The application for the prejudgment remedy is filed prior to the filing of the lawsuit. It can also be filed as a motion after a lawsuit has been returned to court. The court then conducts a prejudgment remedy hearing to decide if the applicant has established probable cause that he will be successful with the litigation. If so established, the court then orders a prejudgment remedy in the amount established by the applicant during the hearing.
